Terms of Service / User Policy

Effective Date: July 31, 2026. By using the MorphPhoto platform, you agree to comply with the following terms.

1. Acceptance of Terms

By registering an account or using any platform service (including browsing the prompt library, uploading prompts, generating images, subscribing to services, etc.), you agree to comply with these terms and our periodically published Community Guidelines and Privacy Policy. If you do not agree, please do not use the service.

2. Platform Account and Registration

• You must provide valid, current, and accurate registration information. Your username must not impersonate others or violate third-party rights.
• You must keep your account password secure. You are responsible for all activities under your account. If you discover unauthorized use, you should notify us immediately.
• We reserve the right to refuse service, suspend, or terminate accounts, especially when users violate the terms or Community Guidelines.

3. Content Upload and Sharing

• You may upload prompts, generated result images or videos on the platform for community browsing and sharing.
• Uploaded content must comply with Community Guidelines: it must be original, respectful of others, and free of spam, infringing content, or illegal/offensive/discriminatory/defamatory content.
• When uploading, you should ensure that you have all necessary rights to the uploaded content (including images, videos, prompts). You grant the platform a non-exclusive, worldwide, royalty-free, sublicensable license to display, edit, and distribute the content you provide, and use it for platform operations and promotion.
• Our team will review content before publication. If we find violating content, we have the right to refuse, delete, block, or require modifications.
• Others browsing or using your prompts (according to the usage terms set by the creator) may use them for commercial or non-commercial purposes. You should indicate the licensing method when uploading (such as "available for commercial use" or "personal use only"). You are responsible for the licensing method you set.

4. Using the Prompt Library and Generation Services

• Browsing the prompt library is free; however, if you want to use prompts to actually generate or edit images, you need credits or an active paid plan.
• You agree to use prompts and generation tools according to the service specifications provided by the platform, and must not abuse, circumvent systems, conduct illegal operations, or violate the terms of the underlying model and infrastructure providers (including Replicate and the BRIA API and the models offered through them).
• Images you generate or edit are owned by you unless otherwise specified; however, you must comply with the usage rules of the platform and the underlying third-party model and infrastructure providers, including but not limited to copyright, commercial licensing, and not generating illegal or infringing content.
• Prompts, generation results, and community content must not be used to violate laws, spread hate, violence, terrorism, infringement, harassment, NSFW content, explicit or sexually suggestive content, deepfakes, face-swaps, impersonation, or other explicitly prohibited behaviors.

5. Subscription, Points and Paid Services

The platform offers a variety of paid options, including credit purchases (for generating and editing images) and subscription plans (including additional benefits).

You agree to pay the corresponding fees on time through the official payment channels designated by us. All payments are made directly to MorphPhoto. The platform does not support any peer-to-peer or third-party transfer transactions.

5.1 Points Policy

• Points (credits) are the right to use virtual content and can only be used within the platform to generate or edit images.
• Points have no monetary value and cannot be withdrawn, transferred, exchanged or given as gifts among users.
• Once points are used to generate or edit content, they are regarded as consumed and cannot be refunded or revoked.

5.2 Subscription Policy

• Subscription plans can be monthly, quarterly or annual (depending on the options provided by the platform).
• During the subscription period, you can access exclusive features, credit allowances, or priority generation services based on your plan benefits.
• Subscriptions automatically renew at the end of each billing cycle unless canceled before renewal. By subscribing and providing a payment method, you authorize recurring charges for each renewal period until you cancel.
• If you fail to make payment on time or violate the terms, we reserve the right to suspend or terminate your subscription service.
• The subscription price may be adjusted. We will inform you by email or in-site notification 30 days before it takes effect.

5.3 Refunds and Disputes

• Refunds are handled in accordance with our Refund Policy. Please review the Refund Policy page for full eligibility requirements, timeframes, and procedures.
• First-time subscription purchases may be eligible for a refund within 7 days of the initial payment, provided the plan quota has not been used beyond the disclosed threshold; renewals, upgrades, downgrades, and repeat purchases are generally non-refundable except for duplicate charges, verified outages, or mandatory rights under applicable law.
• Unused credit packs may be eligible for a refund within 7 days of purchase; consumed credits are non-refundable.
• Approved refunds may exclude non-refundable payment processing fees (up to 5% of the original transaction amount, potentially higher for international payments).
• We aim to acknowledge refund and billing dispute requests within 3 business days; processing times after approval typically range from 5 to 10 business days depending on the payment provider.
• To request a refund, please email support@morphphoto.com with your account email, order ID or payment receipt, and a brief explanation of your request.

6. Community Code of Conduct

You agree to respect the community and others, and the following behaviors are prohibited:

• Uploading prompts or results containing sensitive, illegal, infringing, offensive, discriminatory, harassing, NSFW, explicit, sexually suggestive, pornographic, or adult-oriented content;
• Creating or requesting face-swap, deepfake, impersonation, identity manipulation, or unauthorized realistic depictions of private people, public figures, or third parties;
• Spam/flooding/promotional abuse/bot operations;
• Impersonating others, abusing accounts, exploiting system vulnerabilities;
• Unauthorized use of others' prompts, images, videos, or infringement of third-party rights;
• Claiming or implying that MorphPhoto is officially affiliated with, endorsed by, or part of Google, Gemini, or any AI model provider;
• Misrepresenting the nature of our service or misleading others about our relationship with third-party AI providers.

If you are reported or we discover the above behaviors, we have the right to suspend, delete violating content, terminate accounts, and even notify law enforcement when necessary.

7. Intellectual Property

Platform content (including prompt libraries, interfaces, software, documentation, etc.) is owned by the platform or its licensors, and its copyright, trademarks, and other intellectual property rights are protected by law. You may not copy, modify, distribute, or commercially use without authorization.

Content you upload (prompts, images, videos) is owned by you, but you must ensure that you have the relevant permissions and agree that the platform has the usage license described in Section 3 above.

For others' prompts or results, you should respect their licensing terms, such as notes indicating personal use only or no commercial use.

8. Disclaimer and Limitation of Liability

• The platform is provided "as is" without any express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, or non-interruption.
• We do not guarantee that the generation service is 100% error-free, that generation results will necessarily meet your expectations, that platform services will not be interrupted, or that there will be no viruses or other harmful components.
• To the maximum extent permitted by applicable law, the platform and its affiliates are not liable for any indirect, incidental, special, or punitive damages resulting from the use or inability to use platform services.
• If you cause damage or claims to third parties due to the use of platform content or services, you should bear responsibility yourself and compensate the platform for any resulting losses.

9. Changes to Terms

We reserve the right to modify these Terms of Service at any time. After modification, the platform will notify you on the page, user account interface, or by email. If you continue to use the service after the changes take effect, it indicates that you accept the modifications. We recommend that you review the terms regularly.

10. Termination/Suspension of Service

• If you seriously violate the terms or Community Guidelines, we have the right to immediately suspend or terminate your account.
• If you wish to terminate your account/service, you can cancel your subscription and delete your account according to the process provided by the platform. Your uploaded content and generated results may be deleted or archived, depending on platform policy.
• Termination of these terms does not affect our rights or obligations accumulated prior to termination.

11. Dispute Resolution

• In the event of a dispute, please first contact support@morphphoto.com. Both parties should make a good-faith effort to resolve the issue through negotiation.
• If the dispute cannot be resolved through negotiation, either party may seek resolution from a court or dispute resolution institution with appropriate jurisdiction.
• If any provision of these terms is found to be invalid, it does not affect the validity of the other provisions.
